Terms & Conditions

1. Software License

Project Skia ("Skia") is proprietary software developed and published by Lodestone Digital. Skia is licensed, not sold. By installing or using Skia, you agree to the terms set out in this agreement.

Lodestone Digital grants you a non-exclusive, non-transferable, personal-use license to install and operate Skia on a single device, subject to the tier of license you have purchased.

License Tiers

  • Creator (EUR 39) — Personal, non-commercial use. Single user, single machine. Basic consistency engine, 1080p export, subtle watermark.
  • Professional (EUR 79) — Commercial use permitted. Single user, single machine. Full consistency engine, 4K export, batch generation, no watermark.
  • Studio (EUR 119) — Commercial use permitted with team access. Per-seat licensing, 4K + ProRes export, batch generation, 3D camera controls, priority support.

Each license is valid for one user on one machine and includes 2 years of updates (features, security patches, and new model integrations) from the date of purchase.

2. Third-Party Services (BYOK)

Skia operates on a Bring Your Own Key (BYOK) model. You connect Skia to third-party AI providers — such as Google AI Studio, OpenAI, fal.ai, Black Forest Labs, ElevenLabs, and others — using your own API keys.

  • Lodestone Digital is not responsible for the terms of service, pricing, availability, rate limits, or output quality of any third-party AI provider.
  • You are responsible for reading and complying with each provider's terms of service independently.
  • Lodestone Digital does not receive, store, or transmit your API keys to any party other than the provider you have configured. Keys are encrypted locally on your device and sent directly to the respective provider's API endpoint.

3. Generated Content

Content you generate using Skia belongs to you, subject to the terms and intellectual property policies of the underlying AI provider(s) used to produce that content.

  • Lodestone Digital makes no claim on any user-generated content produced through Skia.
  • You are solely responsible for ensuring that any content you generate, distribute, or publish complies with all applicable local, national, and international laws.
  • Skia includes a mature content toggle that is entirely user-controlled. When safety filters are disabled, Lodestone Digital is not responsible for the nature, legality, or appropriateness of the resulting content.

4. Data & Privacy

Skia is designed with a privacy-first architecture. Your data stays on your machine. The following describes exactly who processes what data:

On Your Device (Complete Privacy)

  • All project files, generated assets, timelines, and local model data are stored exclusively on your device.
  • API keys are stored locally with AES-GCM encryption in a local SQLite database. They are never transmitted to Lodestone Digital.
  • No telemetry or usage tracking. Skia does not phone home, collect analytics, or report usage data to Lodestone Digital or any third party.
  • No account required. Skia does not require user registration. No personal data is collected unless you voluntarily provide it.

Paddle (Payment Processing)

  • All payment and billing data (name, email, payment method, billing address) is processed and stored by Paddle.com, which acts as Merchant of Record.
  • Paddle is the data controller for payment data. Their processing is governed by Paddle's privacy policy. Paddle is GDPR-compliant and SOC 2 Type II certified.
  • Lodestone Digital does not directly receive or store your payment card details.

Lodestone Digital (Licenses & Updates)

  • Lodestone Digital handles license key validation and software update distribution.
  • The only data Lodestone Digital processes is your license key and basic transaction reference (to verify your license tier and update entitlement).
  • Update checks are made over HTTPS to Lodestone Digital's update server. These contain your current app version and platform — no personal data.

Kit (Waitlist Only)

  • If you join the pre-launch waitlist, your email address is managed via Kit and is subject to Kit's privacy policy. You may unsubscribe at any time.

Third-Party AI Providers (BYOK)

  • When you use AI features with your own API key, your prompts and data are transmitted directly from your device to the third-party provider. Lodestone Digital does not intercept, store, or process this data.
  • Your use of third-party AI services is governed entirely by the respective provider's terms of service and privacy policy.

5. Payment & Refunds

Payment Processing

All payments for Skia licenses are processed by Paddle.com, which acts as the Merchant of Record for all transactions. Paddle handles EU VAT, applicable sales tax, and multi-currency conversion on behalf of Lodestone Digital. All purchases are subject to Paddle's buyer terms.

Pricing

Skia is sold as a one-time purchase with three license tiers. All prices are in EUR and inclusive of applicable taxes (handled by Paddle):

  • Creator — EUR 39. Personal, non-commercial use.
  • Professional — EUR 79. Commercial use permitted.
  • Studio — EUR 119. Commercial use with team/per-seat licensing.

Each license includes 2 years of updates, including new features, model/provider integrations, bug fixes, and security patches from the date of purchase.

Founding Member Pricing

The first 100 founding member licenses are available at EUR 29 for a Professional-tier license. Founding members receive all Professional features, 2 years of updates, a Founding Member badge in the app, and a 50% discount on all future major version upgrades. Once all 100 seats are sold, this offer will not be restocked.

Refund Policy

We offer a 14-day money-back guarantee from the date of purchase. If Skia does not meet your expectations, you may request a full refund within 14 days — no questions asked.

  • To request a refund, contact Paddle directly through the receipt email you received at the time of purchase. You can also reach Lodestone Digital at contact@lodestone-digital.com and we will initiate the refund through Paddle on your behalf.
  • Refunds are processed by Paddle and returned via your original payment method. Processing times depend on your payment provider.
  • By purchasing a digital download, you expressly consent to immediate delivery and acknowledge that this constitutes a waiver of the EU right of withdrawal, except as provided by this 14-day money-back guarantee which exceeds the statutory minimum.

Refund requests made after 14 days may be considered on a case-by-case basis at Lodestone Digital's discretion.

6. Updates

Your license includes 2 years of software updates from the date of purchase. During this period, you will receive:

  • New features and UI improvements
  • New model and provider integrations
  • Bug fixes
  • Security patches
  • Breaking API migration fixes (when providers change their APIs)

After the Update Period

  • Your software continues to work. Skia is a perpetual license — the last version you received will continue to function indefinitely.
  • You will no longer receive new features, model integrations, or bug fixes. Security patches will be provided on a best-effort basis in compliance with EU consumer protection obligations.
  • You may purchase a discounted upgrade to extend your update entitlement for a new 2-year period.

Major Version Upgrades

  • Major version upgrades (e.g., Skia 1.x to Skia 2.x) may require an additional purchase or upgrade fee.
  • Customers who purchased within 6 months of a major version release receive the upgrade free of charge.
  • Founding members receive a 50% discount on all future major version upgrades.

7. Limitation of Liability

No Warranty

Skia is an independent software product developed by a small team. It is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by applicable law:

  • Lodestone Digital makes no guarantee of the accuracy, reliability, or consistency of the consistency engine, the availability or compatibility of any third-party AI model, or the quality of any generated content.
  • Lodestone Digital does not warrant that Skia will be uninterrupted, error-free, or free of harmful components.

EU Statutory Rights

Nothing in these terms shall affect any statutory rights you are entitled to as a consumer under applicable law, including but not limited to the EU Digital Content Directive (2019/770). For EU consumers, Lodestone Digital will provide updates necessary to keep Skia in conformity for a minimum of 2 years from the date of purchase.

Lodestone Digital's total aggregate liability arising out of or related to your use of Skia shall not exceed the amount you paid for your license. In no event shall Lodestone Digital be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Skia.

Third-Party API Costs

  • You are solely responsible for all costs, fees, and charges incurred through your use of third-party API providers, including but not limited to unexpected charges, rate-limit overages, or service interruptions.
  • Cost estimates displayed within Skia are approximate and based on current provider pricing. Actual costs may vary. Lodestone Digital is not liable for any discrepancy between estimated and actual API costs.
  • Third-party providers may change their pricing, terms, or service availability at any time. Lodestone Digital is not responsible for any costs or disruptions resulting from such changes.

8. Acceptable Use

By using Skia, you agree to the following:

  • Do not use Skia to generate content that is illegal under any applicable jurisdiction.
  • Do not create deepfakes or digitally impersonate real people without their explicit, informed consent.
  • Do not attempt to circumvent, reverse-engineer, decompile, or disassemble the consistency engine, license validation system, or any other proprietary component of Skia.
  • Respect the terms of service of every third-party AI provider you connect through Skia.

Violation of these terms may result in license revocation without refund.

9. Paddle-Specific Requirements

Paddle.com is the Merchant of Record for all Skia payment transactions. Paddle processes payments, handles tax compliance, and manages buyer protection on behalf of Lodestone Digital.

  • All purchases are governed by Paddle's buyer terms, which you agree to at the time of purchase.
  • Paddle's name will appear on your credit card or bank statement for purchases made through Project Skia.
  • Paddle handles all invoicing, tax receipts, and VAT compliance. Invoices are issued by Paddle as the seller entity.
  • For billing inquiries, refund requests, or payment disputes, please contact Paddle directly or reach out to contact@lodestone-digital.com for assistance.
